The Police Commissioner of New South Wales, Mick Fuller, has said his officers will not be checking the vaccine status of people in restaurants, cafes or pubs, in defiance of the Health Minister’s insistence that it is the police’s responsibility. The Guardian has the story.
The Government is preparing to make public health orders that bar unvaccinated people from entry to certain businesses and venues, until at least December 1st.
Attention has quickly turned to how the orders will be enforced, and whether the onus will fall on individual businesses. Questions about enforcement prompted conflicting accounts on Tuesday.
NSW Police Commissioner Mick Fuller said… his officers would not be patrolling venues to enforce vaccine status.
“The role of police in terms of vaccine passports, we will not be walking through restaurants, cafes and pubs checking if people are double vaccinated,” he said.
“[But] we will certainly be assisting restaurant owners and shop owners if they are refusing entry to someone – we’ll certainly respond to assist those people.”
Speaking to the media later on Tuesday, Health Minister Brad Hazzard said police would be responsible for enforcing the public health orders.
“If the law says you have to be double vaccinated, then of course the police will enforce that, they have no choice but to enforce that,” he said.
Hazzard also indicated venues wouldn’t face fines if an unvaccinated person was allowed entry. Asked why businesses would bother to argue with unvaccinated people if they are not to face a penalty, Hazzard criticised the media for obsessing over minutiae.

Interesting development. Could this be a chink in the armour in the defensive shield of the tyrannical Australian states? Victoria next? Or is that too much to hope for?
I’m not sure – all it is, is a statement of not actively looking for breaches of the regulations. Which, if you had the job of deploying resources makes sense at a practical level rather than as a significant statement.
I read it that way too. There simply aren’t enough police to be checking the vaccination status of people in the numerous restaurants, cafes and bars. And it would be a waste of police resources to even try. Let someone else do that donkey work – a big workforce of over-zealous covid marshalls, say – and only turn up at a premises when someone’s been caught daring to drink or eat without a valid covid passport – when the police can no doubt use their pepper spray or plastic bullets against said offender with impunity!
And it seems clear that they prefer going in mob handed with ten-to-one odds or better.
Probably mostly an operational/resources decision, not a principled one, from NSW’s top cop (Mick Fuller) but it is highly likely that here has been a deal of pushback from rank and file police which also influenced the decision. Morale matters and the few police of integrity (here’s one of them, Alex Cooney, since resigned, alas) who have gone public with their opposition to the brutal suppression of Covid dissent represent, based on their reports, the proverbial tip of a silent iceberg amongst police who didn’t sign up for the paramiitary fireworks and the petty harassment of ordinary, law-abiding civilians but are staying mum to hang onto their jobs.
Mick Fuller certainly hasn’t had a Damascene momemt – he was behind the over-the-top enforcement of lockdown, masking and other restrcitions in NSW, encouraging his force to rack up over 3,000 fines per week for Covid violators whilst ordering them to “put community policing to the side”. He was behind ‘Crime Stoppers’, the anonymous dob-in-a-suspect app and hot-line, encouraging Good Citizens to snitch on their neighbours for breaching Covid rules. So Fuller is just being pragmatic.
Still, it’s good news for all of that, though, because it means that the Vaccine Passport could be stillborn if the cops don’t become proactive and conduct spot-raids on restaurants. With no fines in the offing, it means that the law of the capitalist jungle will prevail and the bottom-line-conscious members of the hospitality and other people-focused business sectors, which have been hit from pillar to post through repeated, extended lockdowns, will take all the customers they can get regardless of vaxx status. With no surprise visits from the Covid cops in the offing, why would they bother with the expense, confrontation and loss of market share that goes with calling in the police when customers rock up without a VP (unless they are Covid nutjobs, in which case good riddance).
Rank-and-file police in NSW and Queensland are also kicking up a legal stink to oppose mandatory ‘vaccination’ amongst their members, whilst in my home state, South Australia, the Police Commissioner has already announced that he will not mandate the vaxx for SA’s police.
There are reports of police in some states (not Victoria, obviously) choosing light-touch policing of anti-lockdown protests and even giving sly thumbs-ups to protesters (they are civilians in uniform, as William Peel saw it, after all). Even in Victoria, some officers are refusing to be detailed to riot squad duties. All is not lost.

The way I’ve heard they get around this market problem in (iirc) Ireland was to pay businesses to join the vaxpass scheme and to subsidise them for any loss of business.
There’s a limit to how far they can push that, hopefully…

Note that they will still get invovled if businesses ask them to – so not sure that it’s much of a victory. Now if they were refusing to get involved at all, that would be a step in the right direction.
I suspect that there is push-back from within the police service – I wonder how many have been receiving notes/letters which ask the question: Whose side are you on?
Well, the police will always get involved if the owner of a business asks a patron to leave and they refuse. The only defense that a patron might have is if the owner asked them to leave because of a protected characteristic or something like that. But, in general, they can ask you to leave for all sorts of reasons like no shoes no shirt no service, etc. and the police will help them if you get shirty.
The only question is if a business wanted to lower the risks of asymptomatic spread by banning the jabbed, would the police allow them to be excluded?
Businesses want to do business. The vast majority will let everyone in.
I fear you may be underestimating the number of Branch Covidians who have gone literally insane.
Not only will they refuse entry and call 666 or whatever the emergency number is Down Under, I fully expect them to rat out businesses run by rational people as well.

Businesses will not be fined if they do not enforce a “vaccinated only” policy. So it is a voluntary identification scheme, where the business has the right to say I accept “vaccinated” punters only?

Pictures from Hamburg showed packed bars on the Reeperbahn with young people who took the injection so they can party again, but they have sadly also got no problem at all with running around with a FFP2 mask clamped in front of their face and vote for the Green party which has done a total U-turn from when they were first founded and wants to introduce even more restrictions on people’s liberties!
And there are enough hospitality businesses who cater to these idiots! Yes, it safes jobs. The ability to earn a living if you are prepared to go along with this shit is important to many. I for one would not work in that environment and am in the lucky position I do not have to for now.

At some point, the police will inevitably realise that they are just as much the victims of this fascistic power grab as everyone else. Everyone has limits and they didn’t sign up to be the SS. That it has taken this long is disappointing but it will happen everywhere – they’re just regular people like the rest of us. The Army will do the same, and then we’ll be in some very interesting territory. I wouldn’t like to be in the shoes of anyone who has caused this chaos. There won’t be a bunker deep enough for them to hide in when this thing comes down.
The French police actually said something similar a month or two ago about it not being their job to enforce VPs and that it would be bad for community relations. Not sure what their current position on that is.
This is good news, because it means that internally the rank & file officers are starting to realise that they – and their families – have to live in the same society, and are filtering issues up the chain of command to the seniors who don’t really GAF as long as they get paid.
I hear that the same thing is happening inside the medical profession.

Still dubious about Fuller’s statement above, but could be that he is just trying to preserve his own job. It’s not impossible that a petition is circulating among NSW cops demanding change at the top.
Man – take it from me – I lived there for decades and most of these lovely Aussie cops would pass the best of the f-scale tests- they go into copdom because they are bullies or were bullied or have serious anger management issues and they thrive in uniform – these police forces have a few good men and a lot of fucked up people on board – none of this surprises me except it’s coming from both sides of politics and so has swept up a lot of soft cock ideologues – all on the vaccine train. Early in the UK lockdown in the spring of 2020, the police in the UK made similar noise about it not being their job to enforce lockdown policy. And that didn’t last long. I’ll be interested to see how long this stance lasts.
Their enthusiasm for it was highly variable between police forces though – Derbyshire Constabulary and one or two others clearly absolutely loved having the opportunity to hassle and bully people. Many others were a bit less obnoxious.

This is standard policing, attending to prevent a breach of the peace. It is the land owners right to refuse entry. They only need to be able to defend their decision in a court of law, the police should attend to keep the peace if the ‘customer’ refuses to leave. This is not attacking peaceful protesters, it is doing what they should be doing.

If there’s another muzzle mandate, I suspect it will happen more. I for one really cannot face another round of being hassled and bullied, and remain polite (I do actually have what the government regards as a valid ‘exemption’ – not that I think anyone should have to wear a mask, of course). If we have another mandate it won’t be long before I finally lose patience and end up telling some jobsworth maskivist to fuck off and leave me alone.

The sad reality is that the majority of vaccinated either don’t mind the vaxxports checks or even perceive them as a sort of special status reward for having “done the right thing” (nevermind it was done on command; in fact the “moral high ground” justifies and washes away from memory being a useless tool of the regime, kind of like when a soldier gets a medal for killing other people). That’s why this policy is so hideous, it actively subverts people into discriminating others and feeling proud about it.

I’ve been lead to believe the whole thing is moot here because we can just self declare as exempt and no one can ask us why? Isn’t this the case in other places too and if not, I wonder how the law differs?
When I was in my 20s I moved to England for work.
One evening I was in a pub with some friends and at kicking out time two policemen were in the pub telling everyone to leave.
I was approached and an officer said to me “do you realise the landlord could be prosecuted for your actions?”.
I’d just been sat there drinking my pint. I’d never experienced this before. It certainly wasn’t something I’d heard of happening in Scotland.
I was surprised that the Police would bother wasting their time on such an endeavour. I’ve never seen it happen since but I’m still of the opinion that Police should be focusing on far more important things.
