President Biden Tells Republican Governors Threatening Legal Action Over Vaccine Mandates: “Have at It”

Covid vaccine mandates will not be imposed on millions of U.S. federal workers and contractors without a fight from a growing list of Republican Party Governors who are threatening lawsuits. But President Joe Biden doesn’t seem to mind the prospect of legal challenges, telling his critics: “Have at it.” The Independent has the story.

The administration is gearing up for another major clash between federal and state rule. But while many details about the rules remain unknown, Biden appears to be on firm legal ground to issue the directive in the name of protecting employee safety, according to several experts interviewed by the Associated Press. 

“My bet is that with respect to that statutory authority, they’re on pretty strong footing given the evidence strongly suggesting… the degree of risk that (unvaccinated individuals) pose, not only to themselves but also unto others,” said University of Connecticut Law Professor Sachin Pandya.

Republicans swiftly denounced the mandate that could impact 100 million Americans as government overreach and vowed to sue, and private employers who resist the requirements may do so as well. Texas Govenor Greg Abbott called it an “assault on private businesses” while Govenor Henry McMaster promised to “fight them to the gates of hell to protect the liberty and livelihood of every South Carolinian”. The Republican National Committee has also said it will sue the administration “to protect Americans and their liberties”. …

The White House is gearing up for legal challenges and believes that even if some of the mandates are tossed out, millions of Americans will get a shot because of the new requirements…

Biden is putting enforcement in the hands of the Occupational Safety and Health Administration, which is drafting a rule “over the coming weeks”, Jeffrey Zients, the White House Covid Response Coordinator, said Friday. He warned that “if a workplace refuses to follow the standard, the OSHA fines could be quite significant“.

Courts have upheld vaccination requirements as a condition of employment, both before the pandemic – in challenges brought by health care workers – and since the Covid outbreak, said Lindsay Wiley, Director of the Health Law and Policy Program at American University Washington College of Law.

Where Biden’s vaccine requirements could be more open to attack is over questions of whether the administration followed the proper process to implement them, she said.

“The argument that mandatory vaccination impermissibly infringes on bodily autonomy or medical decision making, those arguments have not been successful and I don’t expect that to change,” Wiley said. “I think the challenges that are harder to predict the outcome of are going to be the ones that are really sort of the boring challenges about whether they followed the right process.”

The reality of course is that the vaccinated (rightfully fed up with all the restrictions) are now increasingly a danger to the unvaccinated. In today’s black-is-white political speak in most cases you just have to invert the statement to arrive at its true meaning.

The governments cannot ethically admit that through their mass vaccination programme they are basically providing a breeding ground for more dangerous variants and increasing the risk to unvaccinated (e.g. see Marek’s disease), sacrificing such people for purely economic reasons.

That’s also why all the scapegoating attempts are made – to ease any moral concerns that might arise in vaccinated from infecting and harming the unvaccinated. The implicit justification goes something like “the unvaccinated are subhuman idiots who are a danger to everyone, when they get sick, it’s all their fault and a lesson”).

Sure, this crude judgement doesn’t match good ole Christian values much, but we know from Middle Ages that such subtleties can be easily worked around with just a little extra narration.

Strong footing my arse!

Surely the absence of any research supporting this assertion would form the basis of any legal challenge. Set this against the vast body of statistical evidence from Israel and elsewhere which shows pretty uneqivocally that the jabbed are just as likely (if not more so) than the un-jabbed to spread the virus and the evidence of adverse reactions and fatalities, and I don’t see how they can hope to make any plausible argument for mandatory ‘vaccines’. The only way they can prevail is if the courts simply throw the cases out or refuse to hear the evidence. In the current climate of censorship and cancellation which makes that scenario a distinct possibility, I can see why Biden is being so bullish.

The battle is, of course, on the grounds of credibility and rationality for such assertions. Are the judiciary intellectually up to this?

In England, the problem is that there is too much wriggle room in terms of the acceptance of bollocks as ‘professional opinion’, and lack of clear criteria for distinguishing assertion and assumption by the executive from a high bar in terms of rational assessment.

There is an inbuilt tendency to give too much credence to judgment by authority rather than rationality.

Seems that unvaccinated people pose a risk to “vaccinated” people. Seems everybody is admitting that the “vaccine” does not work.

The guy is one of those “social activist” lawyers and has no actual legal experience or legal expertise in the relevant Federal or State law regarding vaccine mandates as relates to employment law. I see no evidence he ever litigated a single case in this specific area. Whereas the lawyers who have litigated in this area and won, employment vaccine mandates, state quite clearly that mandates can only have legal force in very specific public health circumstances for vaccine that have full FDA regulatory approve, i.e 505(b)1 approval. Which none of the SARs CoV 2 vaccines in the US have.

So the employment vaccine mandates might have some legal basis in 4 to 6 years. Maybe.

So this Pandya guy is just another “expert” who has no actual relevant legal area expertise and who is repeating stuff he probably read in a New York Times op ed.

The main problem here seems to be that Biden’s moral values are corrupted – he values some people’s (purported) safety over everyone’s personal liberty, a political stance which in the civilized Western world (unlike in authoritarian China) should be the exact opposite. In that approach he is a complete failure as a statesman and a shame for every American, vaccinated or not. If such decisions get widespread support from voters, it’s basically a declaration of moral bankruptcy for the entire free world (a long time in the making, one might add).

Recent PHE data suggests that those vaccinated earliest are now at increased risk of covid, compared with the unvaccinated.

Sure, there might be some protective benefit to the self (personal choice, I say), but it appears that vaccination is likely to increase risks to others, not decrease.

The vax/no-vax groups are of course self-selecting so they may be different and it’s not a controlled experiment on vaccine effectiveness, but what the recent PHE data showing higher infection incidence rates in the vaxxed certainly do demonstrate is that the idea that many people have that the unvaxxed are more “dangerous” is the wrong way round, and that vax passports will if anything increase people’s risk of infection.

Increasing infections (of the vaccinated) is part of the plan now. Even the star German virologist Drosten (the face of pretty much all the government’s misguided policies) now freely admits that he is looking forward to getting infected multiple times.

Of course, this is still a bit of a hard sell for the population who had been previously duped to believe that the vaccination will protect them from infection (many still believe that), and also been told to accept personal sacrifices to avoid infecting themselves and others.

What’s happening now is that the decision makers are facing the music by doing another u-turn, while trying to minimize/deflect political damage to themselves that could result from people realizing that the official policies are endangering the unvaccinated individuals (and to some extent, the entire population, compared to isolation). This is done with a mix of “divide and conquer” and “blame the victim” strategies, to desensitize and justify all the deaths yet to come. The difference from 2020 is that all deaths back then could be attributed to fate while now many deaths can be attributed to policy.

I’m not so sure about the personal choice thing. It’s like me saying I’m going to introduce these genetically modified seeds into the wild and grow some crops. It’s your choice if you eat these GM foods though. Also, these seeds will spread naturally to the surrounding fields and will likely replace all seeds in time.

The general problem with such ‘pragmatic’ challenges – even if successful – is that they are fundamentally weak, and can be easily overturned simply by the administration rectifying the errors in process.

OK – do it – but the fundamental battle has to be over the human rights issue and the infringement of bodily integrity. Otherwise the road will always be open to authority to cook up a stew of lies and fictions about ‘necessity’ and ‘the common good’.

The central crux is not about process, but credible necessity.

If the relative clarity of the US constitution stumbles in this, we are truly fucked on a global basis, because no constitutional provisions will be able to withstand the scam.

In the minds of people like Biden, Boris, and every other technocrat that believes in government by “experts” the threat lies in the fact that some people aren’t following their commands. As such these independent minded people have to be brought into line so that everyone ends up unquestionably obeying the powers that be a la 1984.

Apparently Morrisons have announced that unvaccinated staff who have to self isolate will not get sick pay but the vaccinated will, because Morrisons hasn’t made enough profit in the last year.
Hopefully those staff sensible enough to have refused the vaccine will not have downloaded the NHS app and even more hopefully people will boycott Morrisons for their immoral stance.

How long before this is a reality?
In a recent poll by UGUVsafuck of  38.68 million adults in the South London suburb of Bromley aged between 11¾ and 47 years of age about the proposal to exterminate all the filthy unvaxed population worldwide, 86% voted in favor, 19% were unsure and 5% refused to answer.
Doubters, think back just 18 months. Remember 3 weeks to flatten the curve? It will all be over when the old and vulnerable have had the jib-jab? Christmas is a goer? No health passports? I could go on…
Back then if anyone had told you where the whole of the Western world would be by the end of September 2021 because of a respiratory virus whose overall survival rate is 99.8% of those infected, you would have accused them of being a full-blown tin hat-wearing conspiracy theorist. Think about it!
How far away are we from the reality of this image? Not too far I would suggest. Just look at much of the USA, Australia, and closer to home Ireland, France, Canada etc etc etc.
In a world that can encourage the unnatural and evil act of harming its CHILDREN by jabbing them with an experimental gene therapy that according to official government statistics (Yellow Card, VAERS, etc) is already known to be potentially lethal to not at-risk youngsters, without parental consent FFS, just about any horror is possible, isn’t it?
Think back, could you have imagined any of this would be for real? It’s almost as if we are living in a parallel universe.
One of my biggest problems is that I can so clearly recall a world that was relatively democratic and free. Sure, we had our moans and complaints about the fools in charge back then. But jeez if we had only known what was heading our way.

More Frankenshots = more Covid cases and illness. Just look at graphs comparing low vaxxed countries with high (like UK). The picture is clear that it’s the shots causing selective pressure to produce nastier variants and illness shoots up. But, of course, Johnson and co will not admitt the problem is of their making. But then, when you base your country’s health policy on advice (instructions) from medical ‘experts’ like Gates and his paid for WHO, don’t be surprised if it doesn’t end well.
