The cause of international justice was dealt a severe blow on Thursday with arrest warrants issued for Israel’s Prime Minister, Benjamin Netanyahu, and its former Defence Minister, Yoav Gallant.
The International Criminal Court took this brazen political move in circumstances where it has no jurisdiction, in breach of its own rules and on the basis of false information.
Jurisdiction is what separates international legal institutions from political ones. The ICC’s jurisdiction is derived from its member states and from other states that accept its jurisdiction over their nationals and their territory. However, Israel did not join the ICC, and the Palestinian Authority is not a state, so neither has delegated any jurisdiction to the ICC.
Further still, the international agreements that created the Palestinian Authority (the Oslo Accords) explicitly said that Israel would have sole criminal jurisdiction over Israelis. So even if the Palestinian Authority could delegate any jurisdiction to the ICC, it had no criminal jurisdiction over Israelis to delegate.
The rules of the ICC have been thrown out of the window. A founding principle of the Court is “complementarity”: the ICC is a complement to national legal systems; it does not replace them. …
Who are the winners of this dastardly enterprise? The internationally proscribed terror group Hamas publicly thanked the Court for its interventions on its behalf. But the message that is sent by this disgraceful development is one of encouragement to terror organisations the world over. It is an unconscionable attack on the inherent right of self-defence that other democratic states may well seek to exercise against similar fundamentalist terrorist organisations in the future.

It must have been former UK Justice Minister Sir Robert Buckland who bizarrely chose Pakistani Muslim Karim Ahmad Khan as the UK nominee for the ICC chief prosecutor post, because Karim Khan was elected by secret ballot in February 2021.
Boris Johnson wisely gave Buckland the boot in September 2021 and replaced him with Dominic Raab, but the damage was done.
Pakistani Muslim Karim Khan feigned impartiality by issuing arrest warrants for Jewish Netanyahu, Jewish Gallant and then adding a Muslim Hamas leader Deif, who had already been dead for months!
Are they so detached from reality that they don’t know the Hamas terrorist is dead?

On the upside, based on the very low civilian death rate and supposed lack of aid in Gaza compared to other urban wars, this will surely give future prime ministers of this country pause for thought before starting any invasions and subsequent losses of British military and local civilian lives like those caused by the warmongers Blair and Cameron in Afghanistan, Iraq and Libya.

This is all getting quite silly. The article does nothing other than criticize the fact that the ICC, whether right or wrong, issued the two arrest warrants. There is not a single word spent on the very weighty crimes Netanyahu and Gallant are being accused of.
A quick internet search reveals that the author, Natasha Hausdorff, is a British barrister, international law expert, and speaker. She is also a UKLFI Charitable Trust Legal Director. What is UKLFI? UK Lawyers for Israel.
How about an unbiased report on the matter?
But her points on the jurisdiction of the ICC are correct.
I am not qualified to say whether Hausdorff is correct or not, however, the ICC has twice rejected Israel’s challenges to the court’s jurisdiction, see https://www.icc-cpi.int/news/situation-state-palestine-icc-pre-trial-chamber-i-rejects-state-israels-challenges.
I would be surprised if the ICC’s work could be so easily dismissed.
The court doesn’t decide whether it has jurisdiction or not.
My ‘silly’ criticism was more at the fact this is the second Daily Sceptic article in two days criticizing the ICC where no mention is made of the alleged crimes. Reports from non-MSM sources make it abundantly clear that genocide is being committed. One would have thought Daily Sceptic might print something from https://antiwar.com/, https://electronicintifada.net/, https://thegrayzone.com/, https://www.middleeasteye.net/, or the like. https://www.haaretz.com/ is also very interesting.
The ICJ has already handled the same subject matter (genocide) so an article defining the role of the ICC versus the ICJ would also be interesting.
The ICC should not exist. “International law” is a dangerous fiction. As in this case, it will only ever be used as a propaganda weapon against Western democracy.
