Recourse against Care Homes that require double vaccination to visit?

Hi all, 

Care Home with a relative in just sent us this letter: 

"We would prefer only fully vaccinated persons to visit the home, and so will require proof of
vaccination. Where someone has not been vaccinated, our management teams will risk assess accordingly. My personal view is that, if someone has refused a vaccination on principle, then we should not be allowing them access into our homes. Such a visitor should be restricted to garden visits only, if at all. That said, it remains an uncomfortable position to be denying such a visit." 

(Note the shift from "prefer" to "require")

Does anyone know whether: 

  1. Care Homes are allowed to do this? 
  2. Is there any legal or regulatory recourse against Care Homes doing this?

Is anyone able to shed some light on this? I'm getting more seriously worried about the prospect of a "vaccine passport" for visiting our relative in a care home.

First and foremost all care facilities have a legal duty of care to protect and safeguard their residents from any form of harm. As they have mentioned a risk assessment, the care provider is therefore aiming to protect its’ staff and residents from a potential outbreak by putting ‘safeguards’ in place, thus meeting their legal responsibilities.

unfortunately, it would be very costly if you to take recourse on this matter and if you were to pursue it, I advise, that you would easily lose.

The care home are not stopping you from visiting either, as they have given an alternative, where you can meet up…

Yes, I know this is all ridiculous, but unfortunately that is the world that health and social care have been in for a very long time now.

Finally though, one thing to also be aware of, as they have discussed managing risks, this will be done on a case by case basis, they may also ask you to take an LFT prior to entering their premises, just to piss you off even further.

The best tactic here is to say that you cannot have the vaccine for a medical reason! This will gain you some sympathy here and prevent them from putting up the barriers before you visit.

I know that this is not the response you were hoping for, but unfortunately that is the realistic one you will get.

Many thanks for your response. To clarify, it's the "if at all" comment that has me most worries. At present I actually quite like the alternative of outdoor visits, though it could get tricky in the Autumn and Winter. My main question at present is if they would make double vaccination compulsively for any kind of visits, would relatives have any rights to contest it?
